Statement of DRC Systems USA LLC to the criminal complaint
Our readers know that we filed a criminal complaint against DRC Systems USA LLC in New York. Today we received from the “Office of the New York State Attorney General” by email the statement of DRC Systems USA LLC.
The manager of DRC Systems USA LLC. is Mr. Mahesh Sutariya.
Mr. Mahesh Sutariya stated in his submission:
”… DRC Systems USA LLC and DRC Systems India Pvt. Ltd. are separate entity and has no direct or legal relation. DRC Systems USA LLC is an affiliate partner of DRC Systems India Pvt. Ltd. I would agree with Mr. Börge about doing payment to our bank account but that is in agreement with DRC Systems India Pvt. Ltd. because his payment was failed to their bank account. We have paid this payment further to DRC Systems India Pvt. Ltd. which is actual receiving party.
In fact, there is no contract done between Mr. Börge and DRC Systems USA LLC about any work or deliverables. Hence DRC Systems USA LLC or me is not liable for any refund to Mr. Börge. …”
That is an interesting statement – especially when viewed alongside the following facts:

In October 2012, Mr. Sutariya and Mr. Hiten Barchha (technical manager DRC Systems) came personally to Hamburg. Mr. Barchha introduced Mr. Sutariya to us as a member of DRC Systems management.

After this visit, Mr. Sutariya sent us an email dated 22 October 2012. In the footer: DRC Systems, phone numbers in India and USA, DRC Systems email address.

On the DRC Systems management website, Mr. Mahesh Sutariya, Mr. Kirit Gajera and Mr. Hiten Barchha regularly appeared as the management team.
